Domestic violence injunctions

Domestic violence injunctions are the first step toward ending the cycle of abuse. If your spouse or domestic partner has committed or threatened to commit an act of domestic violence, you can petition the court to issue a domestic violence injunction against that person. These injunctions prohibit the accused from coming within a specified distance of the victim and any children that they share, as well as the victim’s workplace, place of residence or any other frequently visited locale. Domestic violence injunctions also prevent the accused from contacting, assaulting, menacing or harassing victims in any way.

If you have been awarded a domestic violence injunction by the court, it is important to understand how serious this matter is. If you violate the injunction by meeting with your attacker, the consequences are often harsher than the penalties for the underlying offense.

Domestic battery

Domestic battery often leads people to get domestic violence injunctions entered against their attackers. A domestic battery occurs when a person intentionally causes physical injury to his or her spouse or domestic partner. It is a first-degree misdemeanor offense punishable by up to one year in jail.
